Terms of Service

1. Acceptance of Terms

By accessing or using Snapmet.in (the “Platform”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, you must not access or use the Platform. These Terms constitute a legally binding agreement between you and Snapmet (the “Company”, “we”, “us”, or “our”).

2. Definitions

  • User: Any individual who registers on the Platform and books or participates in chat, audio calls, video calls, or meetings with Creators.
  • Creator: Any individual who registers as a service provider and offers chat, audio calls, video calls, or meetings to Users.
  • Platform / Snapmet: The website, mobile application, and all related services owned and operated by the Company.
  • Wallet: The internal payment system where Users deposit funds and Creators receive payouts after commission deduction.
  • Services: Chat, audio calls, video calls, and in-person or virtual meetings facilitated through the Platform.
  • Content: Any messages, audio, video, files, or information exchanged during Services.

3. Eligibility and Age

The Platform is open to users and Creators of all ages. There is no minimum age requirement. However, all users and Creators must comply with applicable laws of India. The Company does not permit or condone any illegal activities, including child exploitation, and will take immediate and permanent action against any such violation.

4. Platform Role

Snapmet acts solely as an intermediary marketplace that connects Users and Creators. The Company does not provide, supervise, or control the actual Services. All interactions, communications, and meetings occur directly between Users and Creators. The Company has no responsibility or liability for any conduct, content, or outcome of any session.

5. Know Your Customer (KYC) and Identity Verification

To ensure the safety and integrity of the Platform and to prevent any criminal or illegal activities, Snapmet may require Users and Creators to submit identity documents, including but not limited to Aadhaar Card and PAN Card.

The collection of Aadhaar Card and PAN Card is done solely for the purpose of identity verification and compliance with applicable laws. In the event of any suspected criminal activity, fraud, illegal conduct, or upon receipt of a valid request from government authorities or law enforcement agencies in India, the Company may share such identity information with the relevant authorities.

The Company has no other intention or purpose for collecting these documents beyond platform safety, fraud prevention, and legal compliance. By using the Platform, you explicitly consent to the collection, storage, and potential disclosure of your Aadhaar and PAN details for the aforementioned purposes only. Refusal to provide required KYC documents may result in account suspension or termination.

6. User Accounts

You must create an account with accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials. Any activity under your account is your responsibility. Fake, duplicate, or misleading accounts are strictly prohibited and will result in immediate termination.

7. Creator Obligations

Creators represent and warrant that:

  • They will provide the booked Services at the scheduled time.
  • They will not engage in any fraudulent, misleading, or harmful conduct.
  • They will not solicit or conduct business outside the Platform (circumvention).
  • They are solely responsible for the quality, content, and delivery of their Services.

8. Payments, Fees, and Commissions

  • Users must deposit funds into their Wallet to book Services.
  • Upon successful booking, the full amount is held in the Wallet.
  • After the Service is completed, the Company deducts its commission (which may range between 10% and 50% and can be changed by the Company at any time with notice) and transfers the remaining amount to the Creator’s Wallet.
  • The Company may modify commission rates at its sole discretion. Continued use after any change constitutes acceptance of the new rates.
  • All payments are processed through the Platform’s Wallet system only. Direct payments between Users and Creators are strictly prohibited.

9. Refund and Cancellation Policy

  • Full Refund (100%): If the Creator fails to provide the booked Service or if there is a technical error caused by the Platform.
  • Partial Refund / No Refund: In case of misunderstanding, dissatisfaction, or disputes between User and Creator, the Company will retain its commission. The remaining amount may be refunded to the User (deducted from the Creator’s Wallet) after case-by-case review by the Company.
  • Once a Service has started (call or meeting begins), refunds are generally not provided.
  • All refund requests must be submitted within 7 days of the scheduled Service.

10. Prohibited Conduct

The following activities are strictly prohibited on the Platform:

  • Harassment, abuse, threats, or defamation.
  • Spam, unsolicited messages, or fake reviews.
  • Fraud, misrepresentation, or scams.
  • Illegal activities, including but not limited to child exploitation, violence, hate speech, or any content violating Indian laws.
  • Sharing of explicit, adult, or inappropriate Content in a manner that violates applicable laws.
  • Circumventing the Platform by taking payments or bookings off-platform.
  • Reverse engineering, hacking, or interfering with the Platform’s technology.
  • Any activity that could damage the reputation or operation of the Platform.

Violation of any prohibited conduct may result in immediate suspension or permanent termination of your account, forfeiture of funds, and potential legal action.

11. Intellectual Property

All content, logos, designs, trademarks, and technology on the Platform are the exclusive property of Snapmet. Users and Creators grant the Company a worldwide, royalty-free license to use, display, and promote any Content they upload or create on the Platform for marketing and operational purposes.

12. Privacy and Data

Your use of the Platform is also governed by our Privacy Policy. By using the Platform, you consent to the collection, use, and sharing of your data as described therein. The Company complies with applicable Indian data protection laws.

13. Disclaimers and Limitation of Liability

  • The Platform is provided “as is” and “as available” without any warranties of any kind. The Company disclaims all warranties, express or implied.
  • To the maximum extent permitted by law, the Company shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill.
  • The Company’s total liability shall not exceed the amount paid by you in the twelve (12) months preceding the claim.
  • The Company is not liable for any disputes, harm, loss, or damage arising from interactions between Users and Creators.

14. Indemnification

You agree to indemnify, defend, and hold harmless the Company, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including legal fees) arising out of your use of the Platform, your Content, your violation of these Terms, or your interaction with any other user or Creator.

15. Termination

The Company may suspend or terminate your account at any time, with or without notice, for any reason, including violation of these Terms. You may also delete your account at any time. Upon termination, all rights granted to you under these Terms cease immediately.

16. Dispute Resolution

Any dispute arising out of or relating to these Terms or your use of the Platform shall first be attempted to be resolved through the Company’s support team. If unresolved, the dispute shall be subject to the exclusive jurisdiction of the courts located in Ahmedabad, Gujarat, India. These Terms shall be governed by and construed in accordance with the laws of India.

17. Modifications to Terms

The Company reserves the right to modify these Terms at any time. Changes will be posted on the Platform with the updated “Last Updated” date. Your continued use of the Platform after any changes constitutes your acceptance of the revised Terms.

18. Miscellaneous

  • If any provision of these Terms is held invalid, the remainder shall continue in full force.
  • These Terms constitute the entire agreement between you and the Company.
  • No waiver of any breach shall constitute a waiver of any other breach.
  • Force majeure events (acts of God, government orders, etc.) shall excuse the Company’s performance.
  • These Terms are personal to you and may not be assigned without the Company’s prior written consent.
